We know that it’s common practice to snag photos off Google Images, but just because everyone is doing it doesn’t make it right. Whether you are posting images to your blog, Facebook, or any other social media platform, you need to be certain that you are allowed to use that photo or you are breaking the law! Follow these quick and easy guidelines to ensure your use of photos avoids copyright infringement.
Understanding the Law. Copyright law protects any original creation, and grants the holder of the copyright exclusive control over when, how, and by whom their work may be copied, distributed, or exhibited.
2. Don't rely on "fair use". Called "fair dealing" in many jurisdictions, fair use is simply a guarantee that copyright laws do not infringe freedom of speech and make critical commentary impossible. Fair use is an extremely complex body of case law; it is often very difficult for non-lawyers to tell in advance whether or not a certain use will be considered fair use in court.
3. Create your own or pay someone for the original work. If you have the creative or artistic skill, you can create your original materials instead of copying or deriving from other people’s work. If you have the financial resources, then you can also commission other people to be the creators. In this case, you will still hold the copyright under “works made for hire” or within the scope of employment or contract of the creative.
